1. Acceptance of Terms

By accessing or using the Dwellink platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including homeowners, property managers, operators, relocation specialists, insurance adjusters, and displaced families.

2. Description of Service

Dwellink is a relocation housing marketplace that facilitates temporary housing placement for families displaced due to insurance claims. The platform connects property owners and managers with relocation specialists and insurance adjusters to streamline the claim fulfillment and housing placement process.

Dwellink acts as an intermediary platform and is not a party to any rental agreement, insurance claim, or housing arrangement between users.

3. Account Registration

  • You must provide accurate, complete, and current information during registration.
  • Access to the platform is invite-based. You may need a signup invite code or be invited by an existing user.
  • Your account may require administrative approval before full access is granted.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must not share your account or credentials with others.
  • You must be at least 18 years old to use the Service.

4. User Roles and Responsibilities

4.1 Property Owners and Managers

  • You must provide accurate and truthful property information, including descriptions, photos, pricing, and availability.
  • Properties must comply with all applicable local, state, and federal laws and regulations.
  • You are responsible for maintaining properties in safe, habitable condition.
  • Listings are subject to verification and approval by Dwellink administrators.

4.2 Relocation Specialists and Insurance Adjusters

  • You must act in good faith when creating bookings and reviewing claim fulfillments.
  • You are responsible for ensuring that housing placements meet the needs of displaced families.
  • Claim fulfillment information must be accurate and complete.

4.3 Displaced Families

  • You must treat assigned properties with care and respect.
  • You must respond to booking approvals in a timely manner.
  • You are responsible for reporting any issues with assigned properties promptly.

5. Property Listings

  • All property listings are subject to review and verification by Dwellink administrators.
  • Dwellink reserves the right to reject, suspend, or remove any listing that violates these Terms or is deemed inappropriate.
  • Listing status progresses through defined workflows (Draft, Pending, Active, Rejected) and may be updated by authorized users.
  • You must not list properties you do not own or have authorization to manage.

6. Bookings and Payments

  • Bookings are subject to approval workflows involving relocation specialists, insurance adjusters, and displaced families.
  • Payment terms and arrangements are between the relevant parties (insurance companies, property owners, etc.) and are not managed directly by the Dwellink platform.
  • Dwellink is not responsible for payment disputes between users or third parties.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Submit false, misleading, or fraudulent information.
  • Impersonate another person or misrepresent your affiliation with any entity.
  • Interfere with or disrupt the Service or servers and networks connected to the Service.
  • Attempt to gain unauthorized access to any part of the Service or other users' accounts.
  • Scrape, crawl, or use automated means to access the Service without authorization.
  • Harass, threaten, or discriminate against other users.
  • Upload malicious content, viruses, or harmful code.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Dwellink and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you upload (property photos, descriptions, etc.) but grant Dwellink a non-exclusive, worldwide license to use, display, and distribute such content in connection with the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Dwellink does not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, completeness, or reliability of any property listings, user information, or content on the platform.

Dwellink does not verify the condition of properties, the qualifications of users, or the validity of insurance claims. Users are responsible for conducting their own due diligence.

10. Limitation of Liability

To the maximum extent permitted by law, Dwellink and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the Service.

Dwellink is not liable for any disputes, damages, or losses arising from interactions between users, property conditions, insurance claim outcomes, or housing arrangements facilitated through the platform.

11. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion. Users whose accounts are terminated may be assigned the BANNED role and blocked from further access.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
